Overview of the EB5 Investment Visa

The EB5 immigrant investor visa has been referred to variously as the EB5 or EB-5, the EB5 emigration visa and EB5 investment visa. In order to deter fraud, immigrant investors, their spouses and dependent children are initially subject to conditional permanent residence for a two-year period.

The visa holder must file a petition to remove the conditions during a 90-day period prior to the second anniversary of the alien's lawful admission as a permanent resident. The United States Citizenship Immigration Service (USCIS)will examine the business at the end of the two-year period to determine whether or not the alien has complied with all of the requirements.
