Overview of the EB5 Investment Visa

The EB5 immigrant investor visa has been referred to variously as the EB5 or EB-5, the EB5 emigration visa and EB5 investment visa. The particular EB5 immigrant investor visa that we have found of most interest to our clients is the EB5 visa regional centre pilot program which for an investment of $500,000 in an approved regional centre program (which must create jobs for at least 10 US workers) - provides all important green cards for the applicant their spouse and their children under 21.

In order to deter fraud, immigrant investors, their spouses and dependent children are initially subject to conditional permanent residence for a two-year period.
 
The visa holder must file a petition to remove the conditions during a 90-day period prior to the second anniversary of the alien's lawful admission as a permanent resident. The United States Citizenship Immigration Service (USCIS)will examine the business at the end of the two-year period to determine whether or not the alien has complied with all of the requirements.
