EB5 Greencard: The best option for family immigration?

Many families have long dreamt of relocating to the United States but wanted the security of green card permanent residency status for their family rather than the risks associated with many other types of visas.

For example:-

•    The E2 visa only covers certain countries and does not provide permanent residency requires regular renewal and children may have to leave America at 21.
•    The L1 visa is often granted for only one year in the first instance and carries a relatively high failure risk in the current world finance climate.

Family relocates to Florida on the EB-5 visa


The husband owned large specialist employment businesses in Australia and the UK. He required a visa route that offered permanent residency and green cards for all the family – with children he was concerned that there was too much risk otherwise for their future.

After a briefing with us in 2005, they decided to look at the EB-5 pilot program in more detail and subsequently decided to invest $500,000 in a Limited Partnership under a Regional Center in a Targeted Employment area. The Project involved the demolition, renovation and construction of a warehouse/storage complex for mixed use. Upon completion of the construction, the new structure will house tenants and create 10 direct/indirect jobs for each of the Investors in the project.

The family decided to sell their business and property assets which provided them with total net worth well in excess of the required (by the US government) million dollar figure.
The family required an Attorney based in Florida with a track record of working on EB-5 applications and also had a number of questions for us regarding possible locations to settle in, the school system, moving, property, transfer of pets, health insurance etc.

The I-526 approval took several months and the couple were then interviewed at the U.S. Consulate and granted visas.

We have continued to keep in touch and checked out issues that have cropped up with them for the benefit of new investors, a key one being the exit strategy of the program they opted for in the light of the world downturn and subsequent attractive projects coming on the market.

UK nationals living in Florida invested in hotel project to gain permanent residency in USA

A British family living in Florida invested in a Limited Partnership options available under an approved Regional Center in a Targeted Employment Area to qualify for the EB-5 visa. The funds invested, along with investments from numerous other investors from the USA and overseas, went into the purchase and renovation of a historic building in Washington State.
The Limited Partnership plan to renovate and extend the existing building, resulting in the structure’s transformation into a 260 room building operated by a major hotel chain. The immigrant investor invested $500,000 into this project (there were additional administration and attorney costs totaling an additional $40,000). The project is forecast to create over 1600 direct and indirect jobs with each immigrant investor allotted 10 of the created jobs.

The source of funds for the investment were gathered from dividends and officer remuneration acquired from an investment in a UK business as well as income acquired from rental properties in the UK over a number of years.

The immigrant investor’s initial visa petition (I-526) was approved in 14 months, (the project had a number of requests for further evidence (RFE) issued at the time) since then application times are in the region of three months. The immigrant investor had his status within the United States adjusted and subsequently received his permanent Green Card in 2009.
