The US is one of the best countries to invest in. It is a highly successful country with a dynamic and deregulated market. The country has always had a reputation for having plenty of opportunity for a smart investor, and that holds true today.
Investors can find a lot of variety and options in the US. Fortunes can be made here, and while some may be wary after the housing market fell through a couple of years ago, the economy is recovering well. However, the US market is very competitive. This is because everyone knows that there is money to be made here. But don’t let this scare you. Just always remember these simple reminders:
1) Double Check Everything
Just because you’re familiar with US culture via the movies and TV shows, it doesn’t mean you know everything about it. One of the biggest difficulties with foreign investors is adjusting to a different economic culture and a different set of rules. An opportunistic financial planner or broker could easily prey on your naïveté and victimize you. So never take anything at face value and check everything anyone says to you about investments.
2) Do your Due Diligence
Make sure you know exactly what you’re investing in. Research on the business or financial product, the location (states can have different laws on foreign investors), and all the important people you will be dealing with.
Even with a financial adviser you still need to know what you’re getting into. If you see some red flags like bad feedback from the other clients, or shady progress on a project, you need to pull the plug.
3) Follow the Rules
Even with a deregulated market, the US still has certain laws on the financial sector. You need to check if what you’re doing is legal, even after your financial adviser has assured you that it is. The rules vary on different financial products, different states, and different foreign investors. Remember, ignorance does not excuse you from breaking the law.
4) Don’t Do Too Much
A lot of people are tempted to go wild when investing in the US. But this can be too much, too soon. Temper your eagerness with research and learning. If you’re a first time investor in the US, you need to learn before you invest all your life savings. Remember that the US market is still very different from others, so you need to be smart about making and managing your investments.

The USA is one of the best places to invest. The country has recently had some economic trouble but it’s already recovering well. One of the reasons for that is that they have incentives for foreign investors.
Some of these incentives were already in place before, but most are being reinforced and revived to help boost the economy. These can vary from state to state, and some states (Oregon, Wisconsin, Oklahoma, Colorado and Georgia) even have their own foreign-trade office in other countries.
If you’re a foreign investor looking towards the US, you need to be familiar with all the options offered in different states so that you can make your best choice and maximize your investment.
Recent incentives and efforts by the states highlight their territory’s available sites, prime locations, infrastructure, employee skill sets, favorable tax structures, and labor availability. Other incentives for foreign investors include facilities for continued education and learning such as colleges that specialize in industry research.
A prime example of a foreign company that received incentives is the Kia Motors Corporation. They received a $201.4 Million package for their facility in West Point, Georgia. The incentive program includes millions for their land purchase, a sizable job tax credit and sales tax exemptions.
This is an example of the great opportunities for each state, which can offer millions in exchange for boosting economy and providing new jobs. Neighboring states can even outbid each other as they try to woo a prospective investor.
There are also Discretionary Tax Incentives that foreign investors can avail of. For these incentives, certain criteria need to be met. These criteria can include a minimum stay, a minimum of new jobs for local residents, and a certain amount of taxes that need to be paid.
Other states also have tiered systems to encourage new investors in boosting a developing economy. This can be a newly built enterprise zone or a place that is being repopulated or rebuilt.
The incentives can also be granted over a course of time. Taxes can be waived for the first few years or awarded at the end of a certain term. While more incentives can be awarded once an investor or investment reaches a certain benchmark.
The federal government also has its own incentives. A good example of this is the EB5 investor visa program. People who invest a certain amount of money in a state’s chosen programs are granted visas or green cards for their entire family. This means that an investor can bring his family, including the spouse and any children below 21, to the USA.

There is a well-known saying; “Imitation is the sincerest form of flattery” Which basically means that if people copy you they are paying you a compliment. Unfortunately, this may not always be true, as has become clear in the business of providing advice to would-be EB-5 visa applicants.
Some time ago we published a book on the EB-5 visa titled “Green Card via the Red Carpet” and we have since written a series of articles and blogs covering consumer implications behind the EB-5 visa process.
We have noticed over the years that some of the content of our book and articles have been copied by various other companies to advertise their service or product. Just recently, a new entrant into the EB-5 advice business has published an article stating that EB-5 applicants should only seek advice from “experienced” EB-5 consultants; we would like to thank them for that endorsement as they are obviously referring to Which EB5.
As we do not recommend any specific regional center, but instead seek to independently educate potential EB-5 applicants on the positives and negatives of different options, we are concerned that other companies are misleading potential applicants by using our work out of context.

Sometimes we are contacted by potential immigrants who have decided to make an EB-5 visa application for permanent residence in the USA. However, there is one significant problem with the enquiries we receive from certain clients; they have already selected a regional center program and committed their $500,000 to a project.
While it is very important to carry out a detailed investigation through due diligence, to make sure all the detailed information is available upon which to select the most appropriate regional center program, it is crucial to do this before making an application, not afterwards!
It would seem that a number of EB-5 clients only do limited research before attending a sales presentation by a regional center, attorney or selling agent. They then get caught up in the sales hype put out at the presentation, signing up either at the presentation or shortly afterwards without carrying out thorough, detailed, independent research.
It is generally too late to undertake due diligence after an applicant has started the submission process to USCIS. This is particularly unfortunate if they have selected a program which, despite the claims made in its sales material, has some serious flaws which could lead to some significant problems at a later stage, such as refusal of the I-829 petition (a potential reason for deportation) or a flawed program and loss of some or all of their $500,000 capital.

For those applying for permanent residence in the USA via the EB-5 regional center visa program the process certainly seemed a lot simpler a few years ago. For a start there were only a handful of regional centers to choose from in 2007 where today there are about 200 approved by United States citizenship and Immigration service (USCIS) to offer programs.
Despite concerns at the time that those early investors were entering unchartered waters all those first few centers have remained in business several years later.
Nowadays the EB-5 visa has given birth to a whole industry, but all is not always as it seems. Sales and marketing hype has become an increasing feature with promises and guarantees made that are unlikely to always be kept. A number of regional center programs have been terminated by USCIS not long after opening but having already recruited unfortunate Chinese clients.

Recently some clients have been frustrated that after making careful deliberations as to which EB-5 regional center they want to work with their chosen center has filled all positions in its current project and won’t have another opening for a number of weeks. Frustrating as that might be, it is, to me anyway, quite inconceivable to decide to move on to another, perhaps less suitable, project just because it might take a few weeks for a new project from your chosen RC to open up.
Let’s take a quick look at just two of the potential the consequences of a rush decision:
- Risk of losing your $500,000 of capital
- Risk of inferior job creation. Risk of your “Green Card” not being made permanent
Unless you have a genuine timing issue (perhaps a child turning 21 soon) or some other really urgent problem, you might want to re-consider moving from one regional center to another simply to gain a few weeks, the potential losses can be extreme.

In the midst of the recent economic problems in the US, some people may wonder why they should still invest in the country. After being brought down by the folly of an over deregulated financial system, the country is slowly raising itself back up.

It is also the perfect time to place an investment in America, because the country needs to create jobs. In return it is offering an opportunity for you to gain permanent residence and even citizenship in this great country.
