What are the critical differences (that you may not be told about) between a regional center and a regional center project?

Although this question is very rarely asked it does raise a number of significant issues.

Basically a has been approved by the United states Immigration and Citizenship Service () to offer programs that qualify for the requirements. Some regional centers offer constantly differing programs, whereas others offer the same ongoing program.

There are generally three key regional center program models which you need to be aware of.

A regional center offering an ongoing program possibly divided into different stages.

With some of the more established regional centers the same type of program may have been operating for some years. This can make it possible to obtain useful feedback, such as how many visas have been granted, have there been any requests from USCIS for further evidence (RFE’s). As such programs are well established this may lessen the likelihood of having a served on the , which can lead to lengthy delays.

Other regional centers may offer a series of constant new and different programs.

For example, different projects or loan based projects to different entities. The point that needs to be considered in this scenario is; because a regional center has a previous program that went well it is not necessarily certain that the current one (which may be very different) will. For example each project has critical differences such as how much was paid for the building, how certain is it that it will rent out, what are the realistic job creation implications. If every project is unique they may be vulnerable to delays due to a request for further evidence, in addition it can be harder to find meaningful statistics to measure their success.

A number of regional centers provide programs which are unique and more complex as they offer a diverse portfolio. You will probably be told this helps to spread any financial risk and maximize opportunity. However, it may create potential difficulties, particularly in forecasting and monitoring the job creation side given that each separate area of the investment may have to contribute a certain proportion of jobs.

You may have come across a number of press releases, articles and sales promotion material claiming one or other is the best or most successful. Some of you may simply put this down to either typical salesmanship or the center spending to much time listening to the lyrics of that well known Tina Turner classic SIMPLY THE BEST – BETTER THAN ALL THE REST.

As consumer advocates for those considering  , we were interested to know how some regional centers come to the conclusion that they are the best. After all, from your viewpoint as potential immigrants, you may measure the best by the number of successful approvals, at stage, , fewest requests for evidence (RFE’s), quickest approval times and even lowest costs.

We were curious as to which were the particular criteria, centers claiming to be the best, were referring to – was it all or some of these -

•    The greatest number of I-526 approvals. It is interesting that one center claiming to be the best, even on its own investor figures, is actually far behind the two regional centers with the greatest number of I-526 approvals. Interestingly one of these two centers rarely advertises its programs as they are often fully subscribed shortly after launch.

•    The greatest number of I-829 approvals. This may seem an important measurement but there is an argument to be made that past performance may not be a good indicator of future results; particularly when a regional center changes the type of program it offers.

•    The greatest amount of political support; after all, if things go wrong, this may be important.

•    Returning the largest number of investors capital. Less than a handful of centers have or are about to return investor capital. However, these centers are not claiming to be the best – it gets stranger and stranger!

•    The best for creating jobs in a disadvantaged area. This is an important criterion for the US government but the flip side is it may not be advantageous to the viability of a particular program and thus cause complications with the exit strategy.

•    The quickest application times; how often have we heard this!

•    The fewest number of RFE’s.

Irish family successfully relocate to Florida on the EB-5 visa

Today we look at an family who had significant agricultural holdings in Ireland and wanted to provide an elevated standard of living for their family by relocating permanently to the U.S.A.

The family had been monitoring the progress of the for several years. They had originally purchased property on the east coast of and taken lengthy holidays/vacations to see how they would adjust to the American way of life. They then purchased other properties for rental, taking advantage of the bottoming of the property market and to build an earnings portfolio for eventual .

They required a visa route that offered permanent residency and green cards for all the family, and wished to increase their property portfolio once resettled in Florida.

The family decided to sell their business and property assets in Ireland which provided them with total net worth well in excess of the required figure. The approval took three months and the couple were then interviewed at the U.S. Consulate and granted visas.
