EB5 visa program Job creationA recent article in Business week headlined that the program has attracted $1.5 billion and created 31,000 jobs, important additions to an ailing US economy. With the popularity of the program, which is  due to expire in September 2012, streamlining of the application process by The United States Citizenship and Immigration Service () could be very good .

The Bloomberg article comments that many business ventures throughout the U.S. are finding backers through the EB-5. The article then goes on to say:-

“The primary conduit of investments for the EB-5 program faces an uncertain future. About 90 percent of the money is funneled through private companies, known as regional centers, which match overseas investors with businesses in need of capital. These companies are authorized to participate in the program by legislation that expires every few years. They could be shut down if Congress fails to reenact the law by September 2012.

Immigration Services data show that in the past five years regional centers were responsible for nearly 10,000 jobs and more than $400 million in investment. In 2007 there were only 11 of them. Today there are 147, with 146 more seeking approval.”

US Government statistics show that 1,885 people (about half of them from ) got EB-5 visas in the 12 months through September 2010. In the six months through March 2011, the State Dept. estimates it issued more than 2,100 visas. directors say the number of applications has increased because it is so difficult for small businesses to get financing these days.”

With popularity in the EB-5 increasing, the cut off date of September 2012 may be a cause for concern (depending on whether it is renewed.)  Plans presently being introduced by USCIS to substantially reduce the speed of processing applications for the EB-5 may be very good news, allowing several thousand more immigrants to make their applications before the closedown date.

The requires a $500,000 investment in a United States Citizenship and Immigration center (USCIS) Regional Center Programs. The track record of these programs varies considerably and investment terms can be as little as four years. EB-5 Extension News – Senate set to vote Today October 20 2009

The is scheduled to vote at approximately 4:00 pm EDT on the final version of the Fiscal Year 2010 Homeland Security Appropriations Act, which contains numerous immigration provisions including the extension of the EB-5 Program through October 1, 2012.

If this vote actually takes place and is successful for us it means the bill will make its way to President Obama to be signed into law.

EB-5 Visa News – Three year extension on the way

According to our sources in Washington we are on our way to the anticipated 3-year to the . Here is what we know right now:

House and conferees today reached agreement on how to resolve the differing provisions in the House-passed and -passed versions of the fiscal year 2010 Homeland Security Appropriations bill. Conferees included a three year-long extension of the E-Verify Program in the measure, and they included three year extensions of three expiring immigration programs (including EB-5).  Today’s conference committee action readies the measure for consideration by the full House and full . The text of the conference agreement was not available at the time of this writing.

Here is an extract from FY2010 CONFERENCE SUMMARY: HOMELAND SECURITY APPROPRIATIONS.

“Visa Extensions: Provides three year authorization extensions for the religious worker (R visa), rural-serving doctors (Conrad 30-J visa), and investor () programs”.

The final three-year compromise emerged after a very contentions internal debate and a nearly successful effort by some members of Congress to eliminate all immigration extenders from the bill. Communications from the EB-5 regional centers to their individual members of Congress and from the entire EB-5 stakeholder community to congressional leadership were an extremely important factor in the decision to include the extensions.

The conference version of the bill will now go to the House and Senate for final votes in the next few days and then to President Obama for signature.  The final votes are expected to be a formality.

EB-5 extended for three years?

Sources in tell that three immigration issues (including the ) will get a 3-year . This has NOT been confirmed as yet.

“House and negotiators last night reached agreement on the differing provisions in the House-passed and -passed versions of the fiscal year 2010 Homeland Security Appropriations bill.  The House and conferees on the measure have set a meeting for 1:00 pm today to formalize the agreement”.
