The article quoted Stephanie Ostapowich of The United States Citizenship and Immigration Service (USCIS) as stating “The programme facilitates foreign entrepreneurs’ capital investment that creates or preserves US jobs by supporting the establishment of new commercial enterprises or help troubled US-based businesses in economically distressed areas.”

The article also quoted recent reports by the National Foundation for Policy which tracks immigration data. The report stated that getting a Green Card for Indians who have received a university degree from the US can take many years given the large number of -seekers and the limited number of visas available. Indian Green Card seekers who have a degree from an University typically apply in the visa category.

The visa may be of particular interest to wealthy Indian families whose children wish to pursue a University degree and then a career in the USA. Permanent residency status can enable a to immediately benefit from lower tuition fees and work wherever they like without restriction in the USA. However, the article contains some information which requires closer examination as it indicates investments in a certain program have been retained on average 28 months. This cannot be correct if those investments had been to secure an EB-5 visa. Processing and holding requirements would make it unlikely that funds could be returned before a minimum of four years from the initial inception.

These Regional Center projects are required to create at least ten jobs per investor and to qualify for the $500,000 investment need to be in specific rural or Targeted Employment Areas ().

The minimum investment is $500,000 and associated administration, legal and filing fees will amount to approximately $60,000.

Several thousand immigrants have successfully relocated to the USA through the EB-5 visa program. However, there have been a small but important minority who has experienced problems, including loss of some or all of their investment. In addition some face potential from the USA.

Regional Centers generally offer three types of project:-

  1. Loan based investments, generally for a specific number of years.

What is the application procedure for EB5 visas?

I-526 ApprovalThis can be broken down into the following stages:-

1)      status.   Form Petition for Alien Entrepreneur is filed with the California Service Center. This petition requests the (United States Citizenship and Immigration service) USCIS to certify the applicant and the investment as eligible for EB-5 status.

2)     or Embassy interview.   Upon approval of the I-526 petition, (a) if you are in the United States on a non-immigrant visa, your will file for Adjustment of Status by sending form I-485 and supporting documents to the USCIS regional processing center (b) if you live outside the US you must wait for notification from the Embassy in your home country to prepare documents for the visa interview.

3)     Conditional .   Upon approval of Step 2, you receive a form evidencing the approval as well as a travel documents. You will also receive the temporary in the mail. If you are outside the US you must enter the country within six months of the date of the Embassy approval. Your status will be placed in your passport at the port of entry into the .

4)     I-829 Permanent Residency (Removal of Conditions).   After holding your conditional green card for one year and nine months, your attorney will need to file for Removal of Conditions using Form I-829. This procedure enables the USCIS to verify that you have maintained your approved investment for the required two year period and that the into which you invested has been started and the required ten jobs have been created.
