Is the I-829 so important in the EB5 Visa process?

Unfortunately, this is a point that is too often ignored or missed by people looking at the visa as their option for obtaining in the USA.

Some families assume, or are led to believe by regional centers or their agents, that once they have applied for the EB5 visa and been approved by the United States Citizenship and Immigration Service (USCIS) through an petition, all the hard work is over and they are permanent residents of the USA.

However, the important point to keep in mind is that entry into the USA on the EB5 visa is initially through a conditional issued for a two-year period.

In a specific time frame, towards the end of this two-year period, it is necessary to file an I-829 (removal of conditions) petition. Success at this stage sees the removal of these conditions and a permanent green card; failure at I-829 could result in deportation.

Although the conditions for removal seem straightforward there is no guarantee that they will be met.

These conditions relate to:-

•           Sufficient evidence that each investment of $500,000 has been invested in line with the original I-526 application. This should not be taken for granted; there have been examples of a moving funds to an alternate program which led to refusals at the I-829 stage.

•           Sufficient evidence on the creation of ten jobs per investor in the approved targeted employment area.

There are a number of issues that can occur during the two-year period of the conditional green card that could compromise the likelihood of obtaining the I-829 petition and having the .

•           Downturn in the industry in which the project operates

•           Problems in the development or construction of a real estate project

•           Problems in the viability of a project leading to the creation of insufficient jobs to satisfy the ten jobs per investor criteria.

You may have come across a number of press releases, articles and sales promotion material claiming one or other is the best or most successful. Some of you may simply put this down to either typical American salesmanship or the center spending to much time listening to the lyrics of that well known Tina Turner classic SIMPLY THE BEST – BETTER THAN ALL THE REST.

As consumer advocates for those considering  options, we were interested to know how some regional centers come to the conclusion that they are the best. After all, from your viewpoint as potential immigrants, you may measure the best by the number of successful approvals, at stage, , fewest requests for evidence (RFE’s), quickest approval times and even lowest costs.

We were curious as to which were the particular criteria, centers claiming to be the best, were referring to – was it all or some of these -

•    The greatest number of I-526 approvals. It is interesting that one center claiming to be the best, even on its own investor figures, is actually far behind the two regional centers with the greatest number of I-526 approvals. Interestingly one of these two centers rarely advertises its programs as they are often fully subscribed shortly after launch.

•    The greatest number of I-829 approvals. This may seem an important measurement but there is an argument to be made that past performance may not be a good indicator of future results; particularly when a regional center changes the type of program it offers.

•    The greatest amount of political support; after all, if things go wrong, this may be important.

•    Returning the largest number of capital. Less than a handful of centers have or are about to return investor capital. However, these centers are not claiming to be the best – it gets stranger and stranger!

•    The best for creating jobs in a disadvantaged area. This is an important criterion for the US government but the flip side is it may not be advantageous to the viability of a particular program and thus cause complications with the exit strategy.

•    The quickest application times; how often have we heard this!

•    The fewest number of RFE’s.

The EB-5 Visa – actual real life examples

As the regional centre has been a relatively underutilized option it really warrants closer examination particularly over a five year timeframe. On this basis I thought it would be interesting to look at the experiences of those brave pioneers who were among the first to use the program five years ago and have now been through the complete process. Some of the elements that need careful attention are:

• Choosing a center
• Successfully ()
• 
• Integration in the community
•  from temporary after two years (I-829)
• Choice to become U.S. Citizen
• Position to have the original

Many brochures are high on promises but upon further probing have not been operating long enough to give important actual real life examples.

Over the next few days we will look at the experiences of those who pioneered the EB-5 pilot program and see what lessons can be learnt.
