Do EB-5 Visa applicants benefit from U.S. Tax changes?

Yesterday, President Obama and the Republican Congressional leadership tentatively agreed to work on draft legislation that would re-instate US estate January 1, 2011, with an “exemption” of US $5 million for US citizens and US domiciliaries and a maximum estate rate of 35%. The change would remain in effect for two years and the agreement would also extend the 15% maximum income rate on long term real estate capital gains for two years.

One result of the estate tax change would mean that residents that are nonresident aliens of the US would not be subject to US estate tax if their worldwide assets did not exceed US $5 million at the date of death, and they had made no prior US taxable gifts.

Potential estate tax benefits would also apply to certain citizens or residents of , the and certain other countries with which the US has an estate tax treaty.

Caveat   – the agreement is only part of a wide ranging agreement on many other tax issues, the details of which must still be decided upon.

Canadian businessman uses EB-5 visa to live in USA

Citizen of Canada moves to USA on EB-5 visaA businessman’s main priority when looking at relocation to the via the was selecting a to obtain a green card as fast as possible then to recover the initial capital invested as quickly as possible. A return on the investment was felt to be a bonus but not a priority. The businessman initially expressed a preference for a center with a simple business plan that invests in a tangible asset as opposed to providing business loans. He had some concerns regarding a few of the asset based programs compared to loan ones given their potential vulnerability at stage in relation to job creation, poor returns from the initial programs (i.e. less than the initial investment), and ambiguous exit strategies.  The actual process from investment to approval took just under four months and he has now resettled in the USA and remains pleased with his choice.
