New York Times: Potential Trouble with some EB-5 visa programs?

EB5 money used to build the international gem tower NYCAn article in the has highlighted a potential weakness in the EB-5 visa program that may impact on certain projects. The EB-5 visa requires an applicant to invest $500,000 to $1,000,000 in what are termed regional centers; these centers are approved by The United States Citizenship and Immigration Service ().

The EB-5 visa has proved an increasingly popular choice in 2011, interest in the program has grown so fast that the USCIS are attempting to streamline the application process.

Given the tightening of credit availability the EB-5 has been viewed by some real estate developers as the ideal way to raise funds, particularly for construction projects.

The idea behind the program is to create jobs, ten per $500,000 investment in targeted employment areas [T.E.A’s]

An examination of the program by The New York Times suggests that in New York, developers and state officials could be stretching the rules to qualify projects for this foreign financing.

There is concern that developers are relying on techniques to create development zones that are meant to be in areas of high unemployment (thus qualifying for the $500,000 investment) but according to federal and state records are in prosperous ones.

The article mentions as a prominent project the , a 34 storey glass tower in Manhattan that is to cost $750 million with one fifth of the funding coming from EB-5 applicants.

Although it is being built in an area that is reported as one of the wealthiest in the country, the Times reports that through the selective use of census statistics the project falls under (the $500,000) .

The newspaper reported that during an interview a senior federal immigration official, , acknowledged that the program may need more scrutiny and maps being approved by certain states might not adhere to the spirit and intent of regulations.

There is mention of another area which has been classified as being located as an area that needs help attracting jobs; however there are concerns that the zone resembles a gerrymandered political district.

The article does raise an issue that may be of concern, in that if a particular EB-5 project is judged not to be in a properly qualified Targeted Employment or Rural area the $500,000 investment should actually be $1,000,000.

Should you compare projects with the help of a lawyer?

The situation is understandable; you are looking into the various options for your choice of program and are spending days, weeks maybe months (it may seem like a lifetime) searching the internet in an attempt to find information on the relative advantages, or just as importantly disadvantages, of the ever growing number of regional centers.

A number of the most experienced lawyers do not provide guidance on choice of regional centers.  Instead they focus on the legal aspects of the . Indeed there have been a number of seminars where leading EB-5 immigration attorney’s have stressed that Immigration Lawyers should not be providing advice on your choice of regional center – their focus should be on the actual legal immigration process.

So you continue to search for useful information; such as how many successful applicants have each center processed, however, how helpful is that statistic? For example, if a program has a high number of non-English speaking applicants what are the implications that are not readily apparent from the bare statistics?

When a web site quotes comparative statistics how up to date and accurate are those statistics and indeed how meaningful?  The US economy is still undergoing massive changes and regional center programs that were popular a couple of years ago, at a time of significantly higher returns, may require other considerations in the light of a more conservative attitude.

Another factor that is not readily apparent from the web is how are programs actually performing once fully subscribed? Have buildings been constructed, jobs been created, what issues have come to the surface and have investors had their monies returned?

Beware of what you read about the investment

As regular readers of this blog will know we constantly warn about instances of misleading information we discover that involve the .

Unfortunately this week we have discovered an increasing amount of incorrect and misleading information that could spell problem for those looking for accurate information as part of their investigation into the track record of regional centers offering investor green cards.

The question posed by an unsuspecting enquirer on an blog is straightforward enough:-

“I am in the process of selecting a where my main objective would be to make sure that the job creation requirements will be met after two years to get the conditions removed ( petition) from my and to have some assurance that the capital will be recoverable after five or even a few more years. ROI would be less relevant. So far I have been looking at the following regional centers […..] which look promising: Any comments would be appreciated.”

And here the problems start; with a series of supposedly helpful but potentially misleading and dangerous suggestions offered by various responders, a number not using their real names but answering under aliases.

One responder mentions a different regional center that the questioner has not suggested – one of the programs at this center is currently the subject of litigation.

There is no in depth analysis regarding the very important question asked regarding the far reaching implications of job creation.

The questioner makes the comment it is helpful to get advice from people with real experience; unfortunately the type of experience from those that have answered is less than clear!
